Do you have your Canada immigration file pending since 2003?..... Join us to take legal action
We are a Global Immigration and Visa Consulting firm specializing in Canadian immigartion matters. We provide advise on immigrating to Canada and process applications for all types of Canadian temporary and permanent visa classes such as visitor visa, student visa, work permit, skilled worker immigration, business immigration (investor & entrepreneur class), self employed class, family and marraige sponsorship,etc. Members of our firm include lawyers and consultants who have several years of experience and expertise in the field of immigration. We are associated and affiliated with law firms in many different countries around the world.
Our associate international law firm also helps applicants to prepare for their immigration interviews and prepares them to answer the most likely questions to be posed by the visa officer, such as, " Why do people immigrate to Canada or why do you wish to immigrate to Canada?" If necessary, an associate lawyer from our Canadian law firm can remain present at the time of immigration interview.
Immigration is a long and complex process and relocating to another country is not easy. Before one decides to make an application for immigration to Canada, one should ask a question to oneself, "Why do I want to immigrate to Canada?" and compare the pros and cons of immigrating to Canada with other destinations for immigration, countries such as Australia, New Zealand,UK and USA.
However, one of the most important question one must ask before making a decision for applying for immigration to Canada is, "What are the employment opportunities available in Canada for my occupation in the long run?"
As of 26th June 2010, Canadian Immigration regulations have completely changed and it has affected almost every class of temporary visa applicants and permanent immigrants to Canada. However, the most affected class is the skilled worker or the professional class of applicants applying for permanent immigration to Canada.
If you are NOT on the above occupation list, you can still apply under following class / program for immigration to Canada:
(1) If you have 2 years of experience of working in Canada in last 3 years you can apply for immigration of Canada under Canadian Experience class;
(2) If you have studied in Canada for 2 years and have one year work experience you can apply for immigration of Canada under Canadian Experience class;
(3)If you are ready to learn French language you can apply under Quebec skilled worker class.
(4) If you are on H1B visa in USA you can apply under Alberta Skilled worker program.
(5) If you have company to sponsor you in Canada, you can apply with confirmed job offer.
(6) If you have blood relative living for more then one year in the province of Alberta, Saskatchewan or Manitoba, you can apply under respective province's family skilled worker class.
In the last several years, most immigrants to Canada have settled in three major metros of Canada - Montreal (province of Quebec), Toronto (province of Ontario) and Vancouver (province of British Columbia). Since the major bulk of new and prospective immigrants to Canada chose to settle in these three major cities, other cities located in other provinces of Canada such as Alberta, Manitoba, Saskatchewan and the Maritimes do not receive enough immigrants to meet the shortage of skilled workers. Due to the ever-increasing demand for skilled workers in these provinces,the provincial governments entered in to separate agreements with Citizenship and Immigration Canada department to permit them to devise their own immigration policies. These agreements allow the said provinces to select their own immigrants. However, the final medical and security clearance is solely controlled by the Federal government.
Many skilled worker class immigrants, who may not qualify under the Federal immigration regulations, have the option to look in to the possibility of applying under one of the provincial immigration programs.
Do you have your Canada immigration pending since 2003 and after?
If you have filed your Canada immigration case under federal skilled worker in 2002 and after and still pending and you have not received your decision, interview or medical, you can file court case in Federal court of Canada.
Individually to file a case is very expensive and hence we are making a group of applicants to distribute cost and also at same time make your voice known to the government and asking federal court of Canada to direct the Canadian government to make decision in your case as soon as possible.
We have keep very minimum cost of 350 CD$ including court fees.
New Immigration Policy: Oldest cases in backlog may never get processed.
Join our Skilled Worker Mandamus Action
Citizenship and Immigration Canada (CIC) has abandoned its long-applied “first in, first out” processing to one where those who apply under the current Occupation List are processed first. After those applications have been assessed, those who applied under the previousOccupation List will be reviewed. Thus, those who applied as Federal Skilled Workers (FSW) before 26 June 2010 and have not yet had their file assessed should not expect it to be assessed 2011 because the 2011 quota will be filled from applicants who applied after 25 June 2010 and those who have already been assessed. Absent a change in policy, significantly larger visa post quotas or a precipitous drop in new FSW applications, skilled worker applicants who applied before 27 February 2008 and have not yet had their files assessed are unlikely ever to have their files assessed. And, come July 1st, when a new Occupation List will go into effect, applicants who applied before that date will be moved further down the processing queue.
Top Priority case – Filed after July 2011
Second priority case – Filed after 25th June 2010
Third Priority case – filed between 28th November 2008 – 25th June 2010
Last priority case – Filed before 28th Feb. 2008.
Canadian immigration visa posts in Europe and Asia have stated that FSW applications received prior to 26 June 2010 will not be processed in 2011(unless medical forms have already been received). In Manila those who applied between November 2004 and 26 June 2010 and who have not yet received medical forms should not expect to have their files assessed in the foreseeable future. Indeed, the Canadian Embassy at Warsaw advises that it has no idea when it will review files lodged between 27 February 2008 and 26 June 2010, let alone earlier ones; and New Delhi states that it does not plan on assessing pre-Bill C50 files in 2011 or 2012.
FSW Applicants have three choices:
re-apply if their occupation appears on the new 2011 Occupation List;
do nothing and hope their file will be assessed during their lifetime or
ask the Federal Court of Canada to order that their file be
After 1 July 2011, we will initiate two types of court cases; viz.,
1. Mandamus: We apply for "leave”, asking the Court to hear the case,and, if it agrees to do so, we will seek a Court order requiring CIC to process the application.
2. Damages: This action, which does not require permission to be argued, will seek damages for the wages lost from the date CIC estimated the file would be finalized to the date of the court order.
Our fees are 350 CD$ including court fees.

lawyer was a lead counsel in Dragan, where, on 21 February 2003, the Federal Court ordered CIC to assess our 102 litigants' files by 31 March 2003.
Our case caused CIC six months later to abandon its plan to apply retrospectively the new selection criteria in over 100,000 cases.
Canadian immigration is the set of rules, regulations, directives, policies and the Act of Parliament that regulates the entry of each person in to Canada. Immigration, the entrance of people into a country for the purpose of settling there, has always played a central role in Canadian history.It was as much a feature of ancient times, when the ancestors of Canada's native peoples migrated from Asia by land via Beringia or by sea via the Japanese current, as it is of the present day, when immigrants from around the world come to this country in the thousands.
Over the period of time, the complexity of Canadian immigration has attracted Canadian immigration lawyers to develop practice in the area of Canadian immigration law. Primarily, Canadian immigration lawyers assisted families in Canada to sponsor their family members abroad, assisted Canadian businessmen to recruit foreign workers and also represented those people who were subject to deportation order from Canada.
The Canadian immigration department has developed very systematic immigration criteria to recruit economic class immigrants, which includes skilled worker, and business class immigrants in to Canada. The present Canadian Immigration and Citizenship department, also known as CIC Canada, is the most important department of the Canadian government.
In order to apply for Canadian immigration, the applicant is required to make the application using the prescribed immigration application forms.The Canadian Citizenship and Immigration Canada also maintains statistics of the number of immigrants entering Canada, number of applications approved,the kind of people entering Canada and such other data.
Like any other country, Canadian Immigration policy is divided in two parts:
Independent Class or professional class or skilled worker class. [Occupation under which application for immigration to Canada can be made as of 26.06.2010]
If you are not on this occupation you have following options to apply for immigration of Canada:
(i) If you have 2 years of experience of working in Canada in last 3 years you can apply for immigration of Canada under Canadian Experience class;
(ii) If you have studied in Canada for 2 years and have one year work experience you can apply for immigration of Canada under Canadian Experience class;
(iii)If you are ready to learn French language you can apply under Quebec skilled worker class.
(iv) If you are on H1B visa in USA you can apply under Alberta Skilled worker program.
(v) If you have company to sponsor you in Canada,you can apply with confirmed job offer.
Under this class an individual can make an application under the following three categories when he/she is
OUTSIDE of Canada.
1. Applying for Visitor visa ( Tourist visa ): Canada Immigration
An application maybe submitted under this class if the applicant wishes to come to Canada as a visitor or tourist.
The purpose of such a visit should be to visit relatives, to attend a business meeting, to attend a conference
or convention, pleasure trip,participating in a cultural show and such other purpose.
2. Applying for Student authorization ( Student visa): Canada Immigration
An application maybe made under this class if the applicant wishes to come to Canada for purpose of study
as an international student.
3. Applying for Employment authorization ( Work permit ): Canada Immigration
An applicant can make application under this class if he/she wishes to come to Canada and work for a
Canadian company. This is similar to a H-1 visa of USA. In many countries it is also called as work permit visa.
If you have come to Canada under any of the above visa categories, you may apply for extension of your visa while you are WITHIN Canada:
WHILE IN CANADA, you may also apply for any of the following type of visa and change your visa status.
This may lead you to permanent immigration visa of Canada.

This class has become very popular and also known as professional class or skilled worker class and the application is assessed based on a point system. An individual should make an application under this class if he/she wishes to come to Canada based on his/her qualification, work experience and knowledge of English or French language.
This class is also known as business immigration class. One should make an application under the entrepreneur class and self-employed class if he/she wishes to start a business in Canada. A person should make an application under the investor class if he/she DOES NOT wish to start a business in Canada.
